WAGE & HOUR (Continued)

Your employer is required to keep all time records -- not you. Furthermore, failure to properly maintain these records is a violation of the FLSA laws.

Even if your employer has classified you as "salaried" or "exempt," you may be entitled to overtime pay. It is not uncommon for employees to be misclassified, or employers to ignore the requirements of the FLSA altogether.

There are no "substitutes" for paying overtime wages. It is illegal for your employer to offer you comp time or paid time off instead.

Even if you are on-call or working at home, these hours are still usually considered overtime -- thereby requiring overtime wages.

Your employer cannot retaliate against you for bringing an action under the FLSA. It's against the law, and the FLSA protects employees demanding their rights under federal law.
